1. Seller Information
In these Terms & Conditions, “Seller”, “we”, “us”, and “our” refer to the seller operating under the trade name MaryFox Art, whose details are provided below.

2. General Provisions
2.1. These Terms & Conditions govern the use of the website and the purchase of products.
2.2. These Terms & Conditions are made available to the Customer before an order is placed and form part of the contract where accepted in accordance with the checkout process.

3. Order Processing
3.1. Orders are placed through the website checkout. After an order is submitted, the Customer receives an electronic acknowledgement or confirmation of the order. The legal conclusion of the contract is determined in accordance with the electronic ordering process and applicable law and is not based solely on successful payment.
3.2. If an order cannot be fulfilled because a product is unavailable, or because a manifest pricing error or material technical error affected the order, the Seller will inform the Customer without undue delay. Any cancellation will be made only where permitted by applicable law, and any amount already paid for the cancelled order will be refunded without undue delay.

4. Prices and Payment
4.1. All prices are indicated in euros (EUR).
4.2. Prices may be changed at any time without prior notice.
4.3. Price changes do not affect orders that have already been placed and paid.
4.4. Payment is made at the time of placing the order.
4.5. Prices are exempt from VAT under Article 53 of the Portuguese VAT Code (CIVA), where applicable.
4.6. The total amount payable, including any applicable shipping costs, is displayed before the order is confirmed and payment is completed.

5. Delivery
5.1. Delivery is currently available within Portugal.
5.2. Shipping costs are calculated at checkout and are displayed before the order is confirmed and payment is completed.
5.3. Customers are responsible for providing a complete and accurate shipping address when placing an order. The Seller is not responsible for delivery issues caused by incorrect or incomplete shipping information provided by the customer.
5.4. Orders are processed within 1–3 business days.
5.5. During periods of high demand, public holidays, art markets, exhibitions, or other exceptional circumstances, processing times may be extended. Any significant changes to the estimated processing time will be communicated on the website where reasonably possible.
5.6. Any delivery estimate communicated for an order is indicative unless expressly agreed as binding. If no specific delivery date or period is agreed, the goods will be delivered without undue delay and no later than 30 days after the conclusion of the contract, in accordance with applicable law.
5.7. Tracking information will be provided after dispatch.
5.8. Delays caused by circumstances genuinely beyond the Seller’s reasonable control may affect estimated delivery times. This does not limit the Seller’s statutory obligations regarding delivery, the transfer of risk, or any mandatory rights or remedies of the Customer.
5.9. Where the Seller arranges shipment, the risk of loss or damage remains with the Seller until the Customer, or a third party designated by the Customer other than the carrier, acquires physical possession of the goods, except where the Customer independently chooses a carrier not offered by the Seller, in which case the applicable statutory rules apply.

6. Order Cancellation, Returns and Right of Withdrawal
6.1. You have the right to withdraw from your purchase without giving any reason within 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods. Where multiple goods ordered in a single order are delivered separately, the 14-day period begins on the day the last good is received.
6.2. To exercise the right of withdrawal, you may complete the Withdrawal Form available on our website or send any other unequivocal statement communicating your decision to withdraw from the contract, including by email to contact@maryfoxart.com.
6.3. If you use the electronic Withdrawal Form available on the website, we will acknowledge receipt of your withdrawal request on a durable medium within 24 hours. We will then provide any necessary return instructions.
6.4. Orders for non-personalised products may be cancelled before dispatch. For products covered by Section 6.8, the cancellation rules in that Section apply. If a non-personalised order has already been dispatched, the statutory right of withdrawal described above applies.
6.5. The Customer may handle the goods only to the extent necessary to establish their nature, characteristics, and functioning, as would be permitted in a physical shop. The Customer is liable only for any diminished value resulting from handling beyond what is necessary for that purpose, in accordance with applicable law.
6.6. The customer is responsible for return shipping costs.
6.7. The Customer must return the goods within 14 days from the date on which the decision to withdraw was communicated to the Seller.
6.8. The statutory right of withdrawal does not apply to goods made to the Customer’s specifications or clearly personalised products. As a separate voluntary cancellation policy, the Seller may accept cancellation of such an order before production starts; once production has started, cancellation may be refused. This does not affect statutory rights relating to defective or non-conforming goods.

7. Refunds
7.1. Refunds will be issued no later than 14 days from the moment we receive notification of your decision to withdraw from the contract. We may withhold the refund until we receive the returned goods or until the Customer provides proof of the return of the goods, whichever occurs first, in accordance with applicable law.
7.2. A refund made on the basis of proof of return does not affect any rights of the Seller under applicable law if the purchased goods are not actually returned or if the returned goods have suffered a diminution in value for which the Customer is legally responsible.
7.3. Refunds will be made using the same payment method used for the purchase.
7.4. In the event of a valid exercise of the statutory right of withdrawal, the full amount paid for the order will be refunded, including the cost of standard delivery (if paid). Additional costs arising from the customer’s choice of a delivery method other than the least expensive standard delivery offered by the Seller are not refundable.

8. Damage and Defects
8.1. If the product arrives damaged or defective, please contact us.
8.2. Damage caused after delivery due to external factors is not considered a defect.
8.3. Products are covered by the statutory legal guarantee for lack of conformity for three years from delivery, in accordance with applicable Portuguese consumer protection law.
8.4. In the event of a confirmed defect or lack of conformity, the Customer shall be entitled to the remedies available under applicable law.
8.5. If a defect or lack of conformity is confirmed, the Seller will provide the appropriate remedy in accordance with applicable law.
8.6. The statutory legal guarantee does not cover normal wear and tear consistent with the nature of the product, or damage caused by misuse, accidental or mechanical impact, improper handling, or failure to follow the Product Information & Care instructions, where such damage is not the result of a lack of conformity for which the Seller is legally responsible.
8.7. These rights are granted in accordance with applicable European Union and Portuguese consumer protection laws.
8.8. Customers are encouraged to report any damaged or defective items as soon as reasonably possible after discovering the issue. This does not affect any statutory rights under applicable law.

9. Handmade Products
9.1. All products are individually designed, created, and handmade by the Seller. Certain components, including but not limited to findings, chains, clasps, key rings, some types of beads, charms, decorative elements, and other materials, may be commercially manufactured and sourced from third-party suppliers. The use of such components does not affect the originality or handcrafted nature of the finished product.
9.2. Minor variations in colour, shape, size, texture, finish, and other details may occur compared to product photographs and descriptions. In addition, colours may vary slightly depending on your device’s screen settings and display characteristics. Such minor variations are a natural result of the handmade production process and do not in themselves constitute defects or a lack of conformity, provided that the product remains consistent with its description and the characteristics reasonably expected of a handmade product of that type.
9.3. Please carefully review the product description, photographs, and Product Information & Care provided in the description of each product before placing an order. The Product Information & Care instructions made available for the purchased product form part of the product information provided before purchase. Customers should follow those instructions when using and caring for the product. This does not limit any statutory rights relating to lack of conformity.

10. Intellectual Property
10.1. All photographs, product images, product designs, descriptions, texts, graphics, logos, and other materials displayed on this website are the intellectual property of MaryFox Art unless otherwise stated.
10.2. Any copying, reproduction, publication, modification, adaptation, or commercial use of materials from this website without prior written permission is prohibited and may result in legal liability in accordance with applicable law.

11. User Accounts
11.1. Users are responsible for maintaining the confidentiality of their account credentials and passwords.
11.2. Users agree to provide accurate and up-to-date information when creating and using an account.
11.3. We reserve the right to restrict, suspend, or terminate a user account in the event of a breach of these Terms & Conditions, fraudulent activity, misuse of the website, or any other unlawful conduct.

12. Applicable Law
These Terms & Conditions are governed by and construed in accordance with the laws of Portugal. This choice of law does not deprive consumers of any mandatory rights granted under the laws of their country of residence where such protection cannot be excluded by applicable law.

We reserve the right to update these Terms & Conditions at any time. Any changes will become effective upon publication. Such changes shall not affect orders placed before the updated Terms & Conditions become effective. The latest version is always available on this website.

14. Limitation of Liability
14.1. To the fullest extent permitted by applicable law, the Seller shall not be liable for indirect, incidental, special, or consequential losses, including loss of income or other economic losses, unless and to the extent that such losses are legally attributable to a breach by the Seller and are recoverable under applicable law.
14.2. The Seller shall not be liable for damage caused by misuse, improper handling, normal wear and tear, accidental or mechanical damage, or failure to follow the Product Information & Care instructions, except to the extent that the damage results from a lack of conformity or other matter for which the Seller is legally responsible.
14.3. Any liability of the Seller shall be limited to loss or damage for which the Seller is legally responsible under applicable law, including the applicable rules on causation and proof of loss. Nothing in these Terms & Conditions creates any additional liability for the Seller beyond that required by applicable law.
14.4. Nothing in these Terms & Conditions excludes or limits any rights, remedies, or liability that cannot lawfully be excluded or limited under applicable law.

15. Consumer Dispute Resolution
15.1. In accordance with Portuguese Law No. 144/2015, consumers may use an authorised Alternative Dispute Resolution (ADR) entity competent for the dispute. Consumer disputes of low economic value are subject to mandatory arbitration or mediation when, at the consumer’s express choice, they are submitted to the competent legally authorised consumer arbitration centre, in accordance with Article 14(2) and (3) of Portuguese Law No. 24/96.
